Temple Policies
I. Temple’s Duty of Confidentiality
The Temple will keep all medical and health information that You disclose confidential pursuant to the terms of this agreement, invoking all laws protecting the confidentiality of medical records, and the United States Constitution. To effectuate this provision, you agree that You have delivered Your medical information to the Temple with the same expectation of privacy as if the Temple were a medical provider. You hereby assign to the Temple the right to take legal action on Your behalf to preserve the privileged character of Your records.
II. Premises Security
You may use ToDU premises, and premises provided for ToDU use, only for ToDU purposes. You may not allow anyone into ToDU premises, except with prior permission of ToDU. You may not interfere with the proper activity of surveillance systems. You will not introduce any surveillance device into ToDU premises, or video or audio record the physical location of ToDU premises, or anything that occurs on ToDU premises. All keys to the premises are ToDU property. You must deliver all keys upon request of ToDU. You must report any actual or potential breach in premises security to the Manager.
III. Nondisclosure of Private Matters of the Congregation
You affirm that You are not an agent of any investigative or law enforcement agency. You affirm that You have no conflicts of interest that would prevent You from keeping the promises of confidentiality You have undertaken in this Policy. You will not disclose private matters shared in the temple by other temple participants. You will not disclose any information about the Temple in a public medium. You will not serve as an informant for journalistic reporting about the Temple or Your experiences with the Temple unless the Temple approves of Your participation in writing. You will not make favorable or unfavorable public comments, anonymously, under a pseudonym, or under Your own name, about the Temple, or other members, in social media or online postings. You will support a takedown request to remove any social media or other online postings that may be in violation of any of the provisions of this Policy.
IV. Communication Channels (Virtual and Non)
Temple provides various communication channels for congregation members to engage with temple staff, leadership, and each other. These channels may include in-person interactions, telephone, email, social media, and virtual platforms. All communications should adhere to the principles of respect, confidentiality, and integrity.
V. Dispute Resolution
Any dispute You may have regarding the subject of this policy shall first be subject to mediation that You may initiate by written request to ToDU. If mediation fails to resolve the dispute, either party may file a complaint to initiate a federal non-jury proceeding to be held in the County of Kings, in the City of New York, applying the substantive law of New York and the Federal Rules of Evidence. Upon entry of final judgment in such a non-jury proceeding, attorneys’ fees and costs will be recovered by the prevailing party. In any action, both parties waive all Hague Convention service requirements, and consent to court-ordered email service of process pursuant to FRCP 4(f)(3) at their last-known email address.
VI. Inter-temple Conflict
You agree that when a dispute, not requiring formal mediation arises, you will engage in discussion and communicate concerning said dispute with, primarily with the involved parties, and the Temple Board as outlined in the Temples tenets and precepts.
VII. Legal Defense:
Temple will provide legal defense and support to protect the interests of the temple and its members in the event of any legal proceedings arising from temple activities or interactions. Legal counsel will be engaged to represent the temple and ensure compliance with applicable laws and regulations. You hereby assign to the Temple the right to take legal action on Your behalf to preserve the privileged character of Your records.
VIII. Enforcement
By Your membership, you acknowledge that You have received this Policy, agree to comply with its provisions, and understand that any violation of this Policy shall be grounds for ToDU to take appropriate action including revocation of access privileges and an action for injunctive relief to remedy breaches of the Policy in any jurisdiction where it is appropriate.
IX. Membership Revocation
The Temple reserves the right to revoke or suspend membership of individuals who engage in behavior that violates the temple’s values, policies, or code of conduct. Such decisions will be made by temple leadership in accordance with established procedures and principles of fairness and due process.
This policy reflects the Temple’s commitment to maintaining confidentiality, ensuring security, fostering effective communication, promoting conflict resolution, and upholding the integrity of the temple community
